Terms of Service

Jamlet Music, LLC

1. Agreement and service

These Terms govern use of the Jamlet website at jamlet.music and application at app.jamlet.music, operated by Jamlet Music, LLC ("Jamlet," "we," "us"). By accepting these Terms when presented to you, you agree to them. If you do not agree, do not use the service.

Jamlet lets users record musical audio and video contributions, combine them into collaborative projects ("Jams"), and share the resulting performances. Our Privacy Policy explains our handling of personal information.

2. Eligibility and accounts

The current alpha is available only to people aged 18 or older who can enter a binding agreement. It is not intended for school use involving minors. Do not upload recordings of minors to the alpha. A teacher may participate as an eligible adult, but these Terms do not authorize student accounts or override this age restriction.

Provide accurate account information and use only accounts you are authorized to access. Protect your credentials and notify us if you suspect unauthorized access. You are responsible for activity you authorize through your account.

You may sign in using supported authentication methods, including Google. Google's services are subject to its own terms. Do not impersonate another person or misrepresent your affiliation.

3. Free alpha and future features

Jamlet is currently a free alpha. Features may be incomplete, change, or stop working. We do not promise uninterrupted access, permanent storage, a particular level of performance, future privacy controls, or any future feature.

We may introduce optional paid plans later. Prices, billing terms, renewal rules, and cancellation terms will be presented separately before you agree to a purchase. Creating a free account does not authorize future charges.

Keep independent copies of important original material when possible. Jamlet currently does not offer a download feature and should not be your only archive.

4. Link sharing and visibility

Anyone with a Jam link can currently view the Jam. Links may be forwarded to others. The limited alpha cohort does not make the service or a particular Jam confidential.

Only record, upload, or contribute material that you are authorized to share in this way. Consider your surroundings, other people in the recording, and any personal information included. Jamlet cannot guarantee that recipients will not record or copy material they can view.

5. Your content and the permission Jamlet needs

You retain the rights you have in your recordings, compositions, performances, and other content ("Your Content"). These Terms do not transfer ownership of Your Content to Jamlet.

When you submit Your Content, you grant Jamlet a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, synchronize, combine with contributions, and display and perform it as necessary to operate the service and provide the collaboration and sharing features you use. Jamlet may permit its service providers to carry out these activities on its behalf. This permission covers technical adaptations needed for playback and collaboration, not an unrestricted right to exploit your music.

This license lasts while Your Content is available through the service and for a limited additional period needed to process removal, cycle out backups, or satisfy legal obligations. Retained copies are limited to those purposes.

We will seek separate permission before featuring Your Content in Jamlet marketing. This license does not authorize using Your Content to train AI models or supplying it to others for that purpose.

You confirm that you have the necessary rights and permissions for Your Content and its use through Jamlet, including any rights in underlying compositions, lyrics, sound recordings, samples, backing tracks, and other people's performances, images, or voices. Recording a cover song does not by itself establish that all permissions for sharing it have been obtained.

6. Collaborators and use outside Jamlet

By contributing to a Jam, you permit other participants to interact with and combine your contribution through the service's available collaboration features and to share the Jam link.

Jamlet does not determine songwriting credits, ownership shares, royalties, publishing rights, or revenue splits between contributors. Participation alone does not transfer your ownership to another contributor or give anyone a blanket right to commercially exploit your work.

Jamlet does not prohibit republication on other platforms, but you must first obtain all necessary permissions from contributors and other rights holders. Agree separately on credits, editing, distribution, monetization, and commercial releases before publishing a collaborative work elsewhere. These Terms do not grant third-party music rights or replace those agreements.

7. Acceptable use

Do not:

  • Infringe intellectual property, privacy, publicity, or other legal rights.
  • Record or share others without necessary permission.
  • Post unlawful, exploitative, threatening, or harassing content.
  • Upload sexual exploitation material or otherwise endanger children.
  • Impersonate others, commit fraud, or distribute spam.
  • Upload malware, compromise accounts, or bypass access controls.
  • Interfere with service operation or access data you are not authorized to access.
  • Scrape or collect other users' personal information or recordings without authorization.

You remain responsible for complying with laws applicable to your use.

8. Content reports and moderation

Contact us using Section 14 to report abuse, privacy concerns, or suspected copyright infringement. Identify the relevant Jam or content URL, describe the issue, and provide a way to contact you. For copyright complaints, identify the protected work and explain your authority to act for its owner.

We may investigate, restrict access to, or remove content and suspend accounts when reasonably necessary to address violations, legal obligations, security risks, or harm. We may terminate accounts for repeated infringement when appropriate.

Jamlet does not promise to review every contribution or guarantee other users' conduct. This reporting channel is not a representation that Jamlet has registered a DMCA designated agent.

9. Account closure and content removal

You may stop using Jamlet at any time and contact us to request account closure or deletion of information. These requests currently require manual assistance. Removing an account or contribution can affect shared Jams. We will address requests consistently with applicable law and the Privacy Policy.

Copies made independently by other users or published on other platforms may remain outside Jamlet's control. Closing your account does not cancel obligations that arose before closure or separate agreements between contributors.

We may suspend or discontinue accounts or the service for material violations, legal requirements, security concerns, or operational reasons. Where reasonably practicable and legally permitted, we will provide notice and explain available options.

10. Jamlet materials and third-party services

Jamlet's software, branding, interface, and other materials, excluding user content and third-party materials, belong to Jamlet or its licensors. You may use them as part of the service but receive no ownership or general license to reuse them.

Third-party websites and services have their own terms and privacy practices. A link or integration does not mean Jamlet controls or endorses them.

11. Disclaimers

To the extent permitted by applicable law, the alpha service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant that it will be error-free, secure against every threat, continuously available, or suitable for your particular purpose.

Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot lawfully be excluded.

12. Liability

To the extent permitted by law, Jamlet is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from use of the service.

These exclusions do not apply to fraud, willful misconduct, gross negligence, or other liability that applicable law does not permit us to exclude or limit. Nothing here limits any mandatory consumer rights.

13. Governing law, disputes, and changes

Delaware law governs these Terms, except where applicable law requires otherwise. Subject to mandatory rights to bring claims elsewhere, disputes may be brought in the state or federal courts located in Delaware, and the parties consent to those courts' jurisdiction. Consumers retain mandatory protections and forums available under applicable law.

These Terms do not impose mandatory arbitration or a class-action waiver. You may contact us to try to resolve a concern informally, but doing so is not a condition for exercising legal rights.

We may update these Terms prospectively. We will identify the effective date, give reasonable notice of material changes, and request acceptance where required. Changes do not retroactively expand rights to use content you previously submitted. If you do not accept revised Terms, you may stop using the service and request account closure.

If part of these Terms is unenforceable, the remainder continues to apply to the extent permitted by law. Failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination, including ownership, accrued obligations, and dispute provisions, survive.
